1. Background
The purpose of this policy is to ensure the protection of personal information and to govern the manner in which Le Groupe P. F. Brisson Peinture collects, uses, communicates, retains and destroys or otherwise manages your personal information.

This policy applies to Le Groupe P. F. Brisson Peinture, including but not limited to its officers, employees, customers, suppliers and consultants, as well as any person who otherwise provides services on behalf of Le Groupe P. F. Brisson Peinture. It also applies to Le Groupe P. F. Brisson Peinture website.
For the purposes of this policy, personal information is information about an individual that directly or indirectly identifies the individual. For example, name, postal address, e-mail address and telephone number are personal information.
Sensitive personal information is information towards which there is a high reasonable expectation of privacy, e.g. health information, banking information, biometric information, sexual orientation, ethnic origin, political opinions, religious or philosophical beliefs, etc.
Generally speaking, an individual’s professional or business contact information does not constitute personal information, for example, an individual’s name, title, address, e-mail address or business telephone number. More specifically and for the sake of clarity, within the meaning of the Act respecting the protection of personal information in the private sector of Québec, and as of September 22, 2023, sections 3 (collection, use, communication), 4 (retention and destruction) and 5 (data security) do not apply to an individual’s information relating to the exercise of a function within an enterprise, such as name, title, function, as well as address, e-mail address and telephone number at the place of work.
These same paragraphs do not apply to personal information that is public by law, as of the effective date of this policy.

3. Collection, use and communication
In the course of its activities, Le Groupe P. F. Brisson Peinture Group may collect personal information about you in order to build a file, but it must collect only the information needed to perform its task. Le Groupe P. F. Brisson Peinture must also inform you of :

  • the purpose of the file;
  • how the information will be used;
  • the categories of people who will have access to it within the company;
  • where your file will be kept;
  • your rights of access or rectification.

Consent :
In general, Le Groupe P. F. Brisson Peinture collects personal information directly from the individual concerned and with his or her consent, unless an exception is provided for by law. Consent may be implied in certain situations, for example, when the individual decides to provide his or her personal information after being informed of this privacy policy.
Normally, Le Groupe P. F. Brisson Peinture must also obtain the consent of the person concerned before collecting his or her personal information from third parties, before communicating it to third parties or for any secondary use thereof. However, Le Groupe P. F. Brisson Peinture may act without consent in certain cases provided for by law and under the conditions set forth therein.
Ownership, use and disclosure :
Le Groupe P. F. Brisson Peinture Group ensures that the information it holds is up-to-date and accurate at the time it is used to make a decision regarding the individual concerned.

Groupe P. F. Brisson Peinture may disclose some of your personal information to any person to the extent permitted or required by law.

Generally, and unless an exception is indicated in this policy or otherwise provided by law, Le Groupe P. F. Brisson Peinture will obtain the consent of the individual concerned before disclosing his or her personal information to a third party. In addition, where consent is required and where sensitive personal information is involved, Le Groupe P. F. Brisson Peinture will obtain the individual’s express consent before disclosing the information.

4. Retention and Destruction of Personal Information
Personal information used by Le Groupe P. F. Brisson Peinture is protected by technical and operational safeguards that vary depending on the sensitivity of the information. All our employees who have access to personal information are governed by this Privacy Policy and Confidentiality Policy.
Personal information will be retained only as long as necessary or relevant, or as required by law. When retention is no longer required, personal information will be destroyed or deleted.
The destruction of information by Le Groupe P. F. Brisson Peinture will be done in a secure manner to ensure the protection of such information.
This section may be amended from time to time in accordance with applicable laws.

5. Data security
The P. F. Brisson Peinture Group is committed to implementing reasonable security measures to ensure the protection of personal information under its control.

6. Rights of access, rectification and withdrawal of consent
To exercise his or her right of access, rectification or withdrawal of consent, the person concerned must submit a written request to that effect to the Privacy Officer of Le Groupe P. F. Brisson Peinture, 55 rue Adrien Robert, Gatineau, Qc, J8Y 3S3 or by e-mail at reception@brissonpeinture.com.
Subject to certain legal restrictions, individuals may request access to their personal information held by Le Groupe P. F. Brisson Peinture and request its correction if it is inaccurate, incomplete or equivocal.

7. Complaint Handling Process
You may lodge a complaint about the collection of personal information that you consider unnecessary in the circumstances. To do so, send your complaint in writing to the Commission d’accès à l’information – Direction de la surveillance, taking care to include all documentary or other evidence in support of your complaint, as well as the contact details of the parties involved. If you have no supporting documentation, you must initiate a written request to the company to justify this collection of information under the Act respecting the protection of personal information in the private sector.
Any person wishing to file a complaint concerning the application of this policy or, more generally, the protection of his or her personal information by Le Groupe P. F. Brisson Peinture, must do so in writing to the person responsible for the protection of personal information at Le Groupe P. F. The individual must indicate his or her name, contact information, including a telephone number, as well as the subject and reasons for the complaint, taking care to include all documentary evidence in support of the complaint.
